Acknowledgement

myTurnCareers LLC is a Virginia Limited Liability company. Our goal is to provide people with the Information and tools to achieve their career aspirations.

These Terms & Conditions (“Terms & Conditions”) are entered into between you (“you” and “your”) and myTurnCareers LLC (“myTurnCareers”, “MyTurn”, “we”, “us”, and “our”). The Terms & Conditions govern your access to and use of the MyTurn website at https://www.myturn.com/ including any content, functionality and services offered on or through it (the “Site”).

By using the Site, you agree to be bound and abide by these Terms & Conditions. MyTurn may terminate your use of the Site without notice if you do not comply with the Terms & Conditions and reserves the right to make changes to the Site and to the Terms & Conditions at any time. All changes are effective immediately when posted. Your continued use of the Site following the posting of the revised Terms & Conditions means that you accept and agree to the changes.

Unless stated otherwise, all Information MyTurn collects on this Site is subject to our Privacy Policy (“Privacy Policy”). By using the Site, you consent to all actions taken by us with respect to your Information in compliance with the Privacy Policy. The Privacy Policy is incorporated into and governed by these Terms & Conditions. To the extent there is a conflict, the Terms & Conditions supersede the Privacy Policy.

Terms like “Information” that are in these Terms & Conditions but not defined here are defined in the Privacy Policy.

All Site Content (as defined below) is current as of the date it is posted on the Site to the best of MyTurn’s knowledge.

You may not access or use the Site if you (1) do not agree to these Terms & Conditions and (2) are not 18 years of age or older.


Beta Software

Beta software is a version of software that has not yet been released to the general public. MyTurn, at its sole discretion, may offer beta testing to selected, interested customers. If you use our Product or Service during beta testing, you are asked to provide feedback to MyTurn and assume all risks associated with the Beta software. MyTurn advises all Beta users to use extreme care when testing software since beta software is subject to strict confidentiality and the quality of the software is still under evaluation. BY UPLOADING, DOWNLOADING, OR USING MYTURN’S BETA SOFTWARE, YOU EXPRESSLY AGREE TO THE FOLLOWING TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ANY PROVISIONS CONTAINED HEREIN, YOU MUST NOT UPLOAD OR DOWNLOAD AND YOU SHALL IMMEDIATELY DISCONTINUE ANY USE OF THE BETA SOFTWARE. You acknowledge and agree that MyTurn offers Beta software “as is” without warranty of any kind, express or implied, and subject to the terms contained within this Agreement. MyTurn shall have no obligation to maintain, correct, update, change, modify, or otherwise support the Beta software in Beta testing. MyTurn may discontinue providing service to the Beta software at any time. MyTurn makes no guarantee or commitment as to the success of the Beta software. You acknowledge that the Privacy Policy set forth or referenced herein WILL NOT apply to Beta testing and no privacy or security should be reasonably expected during Beta testing. Beta testing is at the entire risk of you, not MyTurn. MyTurn shall not be liable for any lost revenue, lost profits, or other incidental or consequential damages even if advised of the possibility of such damages by reason of any performance or non‐performance under this Agreement, including, but not limited to, the Beta testing software. Furthermore, MyTurn shall not be liable for any delays, losses, or other damages which may result from the furnishing or canceling of any MyTurn software, features, and/or modules, including, but not limited to, the Beta testing software.


Applying Through MyTurn

Some job postings permit you to complete and submit your application and/or resume through MyTurn. We provide this service by working directly with employers or by searching the Internet for the best contact Information associated with employers. When you submit your application and/or resume through MyTurn, we will send your materials to the most appropriate contact we have on file for that employer.

In some instances, the employer may refer you, or require you to submit your application, to a third-party website. Because we have no control over the websites of employers, we cannot guarantee that your application will be properly received by an employer. If you have reason to believe that your application was not received by an employer, we recommend contacting that employer directly to confirm the status of your application.

MyTurn does not guarantee the identity of any employer or any individuals working for any employers. We encourage Site users to be cautious when applying for jobs. MyTurn does not guarantee the validity of a job offer and encourages Site users to verify the validity of a job offer before taking any actions in connection with your current employment. You are solely responsible for verifying the accuracy of any employers or job offers you encounter in connection with the Site.


Intellectual Property

The Site and its entire content, data, features and functionality (including but not limited to text, graphics, video, logos, button icons, databases and images, “Site Content”) are the property of MyTurn and/or others with whom it does business and are protected by copyright, trademark and other intellectual property laws, except as indicated below.

The “MyTurn” name and related logos are trademarks and service marks (“Marks”) of MyTurn. The Marks may not be used without advance written permission of MyTurn, including in connection with any product or service that is not “MyTurn” in any manner that is likely to cause confusion, or in any manner that disparages, discredits, or misrepresents MyTurn. Other products or company names mentioned on the Site may be trademarks or service marks of their respective owners.

If you believe that any content on the Site violates your intellectual property rights, please notify MyTurn as described in Section 22 below.


Limited License and Prohibited Uses

MyTurn grants you a personal, royalty-free, non-assignable, and non-exclusive license to access and use the Site Content in the United States only as an informative resource while using the Site. Any other use, including the reproduction, modification, distribution, transmission, republication, framing, display, or performance of Site Content without prior permission of MyTurn is strictly prohibited. You may not download, print, copy, distribute, or otherwise use Site Content for commercial purposes, including publication, sale, or personal gain. You may not remove any Mark or other proprietary notices, including, without limitation, attribution Information, credits, and copyright notices that have been placed on or near the Site Content.

You may use the Site only for lawful purposes and in accordance with these Terms & Conditions. By using the Site you agree that you will not:

  • Use the Site in any way that violates any applicable federal, state, local or international laws or regulations.
  • Use the Site for the purpose of exploiting, harming, or attempting to exploit or harm anyone or entity in any way.
  • Gather Information about other members (or visitors) without their consent.
  • Send, knowingly receive, upload, download, use or re-use any material which does not comply with the Terms & Conditions.
  • Transmit, or procure the sending of, any advertising or promotional material, including any “junk mail”, “chain letter” or “spam” or any other similar solicitation.
  • Impersonate or attempt to impersonate MyTurn, a MyTurn employee, another user or any other person or entity (including, without limitation, by using e-mail addresses associated with any of the foregoing).
  • Engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site, or which, as determined by MyTurn, may harm MyTurn, its business partners, or users of the Site or expose them to liability.
  • Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party’s use of the Site, including their ability to engage in real time activities through the Site.
  • Use any robot, spider or other automatic device, process or means to access the Site for any purpose, including monitoring or copying any of the material on the Site.
  • Use any manual process to monitor or copy any of the material on the Site or for any other unauthorized purpose without MyTurn’s prior written consent.
  • Use any device, software or routine that interferes with the proper working of the Site.
  • Introduce any viruses, Trojan horses, worms, logic bombs or other material which is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer or database connected to the Site.
  • Attack the Site via a distributed or other denial-of-service attack.
  • Otherwise, attempt to interfere with the proper working of the Site.
  • Contribute inaccurate Information to MyTurn in any capacity. This includes, but is not limited to, Information contained on a resume, Information in comments, Information submitted in job listings, etc.

Account Registration

To access portions of the Site, you may be asked to provide registration details or other Information. It is a condition of your use of the Site that all Information you provide is complete, current, and accurate. All Information you provide to register with the Site or otherwise is governed by our Privacy Policy, and you consent to all actions MyTurn takes with respect to your Information consistent with our Privacy Policy.


Use and Protection of Login Credentials

You are responsible for maintaining the confidentiality of your user name and password (“Login Credentials”), if applicable. You are responsible for all uses of your account and Login Credentials, whether or not authorized by you. You agree to notify MyTurn immediately of any unauthorized access to or use of your account or Login Credentials or any other breach of security. MyTurn reserves the right to disable your Login Credentials at any time in its sole discretion for any or no reason, including if, in MyTurn’s opinion, you have violated any provision of these Terms & Conditions. Using the account of another person in any capacity will be considered a breach of these Terms & Conditions.


Fees

You are solely responsible for all fees associated with your use of the Site and for any and all duties, taxes, levies or fees (including sales, use, or withholding taxes) imposed by any authority on you by virtue of your transactions through the Site. Payments are nonrefundable, and no credits will be given for partial or incomplete use. We reserve the right, in our sole discretion, to provide refunds, discounts, or credits to Site users on one or more instances without obligation to do so in the future.


Copyright Complaints; Digital Millennium Copyright Act

If you believe that your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have been otherwise violated, you should notify us of your infringement claim in accordance with the procedure set forth below. We will process and investigate notices of alleged infringement and will take appropriate actions under the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws with respect to any alleged or actual infringement. A notification of claimed copyright infringement should be emailed to MyTurn's Copyright team at info@myturn.careers (Subject line: “DMCA Takedown Request”). Our designated copyright agent to receive DMCA Notices is: myTurnCareers LLC. ATTN: 13800 Coppermine Rd. 1st Floor, Herndon, VA 20171 info@myturn.careers To be effective, the notification must be in writing and contain the following Information:

  • an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
  • a description of the copyrighted work or other intellectual property that you claim has been infringed;
  • a description of where the material that you claim is infringing is located on the Site, with enough detail that we may locate it;
  • your address, telephone number, and email address;
  • a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law; and
  • a statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf.
Counter-Notice:
If you believe that your User Contribution that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to upload or display the content in your User Contribution, you may send a written counter-notice containing the following information to the above-listed Copyright Agent:
  • your physical or electronic signature;
  • identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
  • a statement that you have a good-faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
  • your name, address, telephone number, and email address, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Copyright Agent, the Company will send a copy of the counter-notice to the original complaining party, informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our sole discretion. We may, at our sole discretion, limit access to the services and/or terminate the account of any user who infringes any intellectual property rights of others.

User Contribution

The Site may contain sections that allow users and employers to post, submit, publish, display, or transmit to other users or other persons (hereinafter, “post”) content or materials, such as reviews, resumes, salaries, job search criteria, profile information, etc. (“User Contributions”) on or through the Site. All User Contributions must comply with the content standards set out below. Any User Contribution you post to the Site will be considered non-confidential and non-proprietary. By providing any User Contribution on the Site, you grant us and our affiliates and service providers, and each of their and our licensees, successors, and assigns the perpetual right to use, reproduce, modify, perform, display, distribute, and otherwise disclose to third parties any such material for any purpose. You represent and warrant that:

  • You own or control all rights in and to the User Contributions and have the right to grant the license granted above to us and our affiliates and service providers, and each of their licensees, successors, and assigns.
  • All of your User Contributions do and will comply with these Terms & Conditions.
  • You understand and acknowledge that you are responsible for any User Contributions you submit or contribute, and you, not MyTurn, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.

We are not responsible or liable to any third party for the content or accuracy of any User Contributions posted by you or any other user of the Site.


Provisions Applicable to Employers.

Job Postings on MyTurn.
MyTurn runs and maintains a job board, where employers can post jobs and users can search for open jobs. This means that any employers or potential employers who are posting on MyTurn (or otherwise contributing content) are further bound by additional requirements. If you use MyTurn as an employer or otherwise contribute to our job board, you agree:
  • That jobs and job requirements will be legal in the state where they will be performed. Employers must follow all applicable laws, including but not limited to state, federal, and international labor, and discrimination laws.
  • That all job screening requirements are actual and legal requirements of the advertised position.
  • Not to submit false or misleading data, or false or misleading representations about a company, a job, or an industry.
  • Not to post any job that requires a fee or any form of payment to apply, requires users to recruit additional persons, or only pays commissions (except where the job post makes clear that the available job pays commission only and clearly describes the product or service that the job seeker would be selling).
  • Not to post any job that resembles a multi-level marketing scheme, franchise, pyramid scheme, “club membership,” distributorship, or sales representative agency arrangement.
  • Not to post any job that contains multiple job openings in a single job post.

MyTurn has the right, in its sole discretion, to remove or prevent the posting of any job for any or no reason.
Reviews

MyTurn permits Site users to post employer reviews. Employers may not offer incentives in order to obtain favorable reviews, and employers may not trade reviews with other employers. If we have evidence to believe that any person was artificially incentivized to leave a review, we will remove the review associated. All reviews must follow our review guidelines.

Communications with Site Users

On behalf of employers, we may send out reminder emails to applicants you wish to interview. MyTurn may also notify applicants that your job posting is potentially a match for their resume. You understand and agree that MyTurn may take such actions.


Third Party Content

This Site includes content provided by third parties. All statements and opinions expressed by third parties are solely the opinions and the responsibility of the person or entity providing those materials. Those materials do not necessarily reflect the opinion of MyTurn. MyTurn is not responsible for the content or accuracy of any materials provided by any third parties.


Links To Other Web Sites

MyTurn may provide links to external web sites for the convenience of Site users. The inclusion of an external link on this Site does not constitute or imply support or endorsement of any kind. MyTurn does not control those websites, is not responsible for their content or function, and is not responsible for any loss or damage that may arise from your use of them. If you decide to access the third-party Sites linked to this Site, you do so entirely at your own risk and subject to the terms and conditions of use for such sites.


Disclaimer And Limitation of Liability

WHILE MYTURN ATTEMPTS TO PRESENT ACCURATE INFORMATION ON THE SITE, THIS SITE IS PROVIDED ON AN “AS-IS” BASIS. MYTURN MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OR CONTENT OF THIS SITE OR ANY OTHER SITE TO WHICH IT IS LINKED. TO THE EXTENT PERMITTED BY LAW, MYTURN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTIES OF NON-INFRINGEMENT OF ANY PATENT OR OTHER INTELLECTUAL PROPERTY RIGHTS OF A THIRD PARTY. Indemnification

You agree to defend, indemnify and hold harmless MyTurn, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any liabilities, damages, judgments, awards, losses, costs, third party claims, expenses and fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms & Conditions or your use of the Site, including, but not limited to, your content, any use of the Site Content, and services and products other than as expressly authorized in these Terms & Conditions.


Limitation On Time To File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE SITE MUST BE COMMENCED WITHIN THREE (3) MONTHS AFTER THE EVENT GIVING RISE TO THE ACTION OR CLAIM OCCURRED, REGARDLESS OF WHEN YOU KNEW OR SHOULD HAVE KNOWN ABOUT IT; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED


Injunctive Relief

You agree that a breach of these Terms & Conditions will cause irreparable injury to MyTurn for which monetary damages would not be an adequate remedy and MyTurn shall be entitled to seek equitable relief, in addition to any remedies it may have hereunder or at law, without having to post a bond or other security or prove damages.


Waiver And Severability

No waiver by MyTurn of a term or condition set forth in these Terms & Conditions shall be deemed a continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of MyTurn to assert a right or provision under these Terms & Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms & Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms & Conditions will continue in full force and effect.


Entire Agreement

The Terms & Conditions, our Privacy Policy and other legal notices posted on MyTurn Site constitute the sole and entire agreement between you and MyTurn with respect to the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Site.


Term and Termination

These Terms & Conditions will remain in full force and effect while you use the Site. Even after you are no longer a user of the Site, certain provisions of these Terms that by their nature are intended to survive will remain in effect, including sections 1-2, 4, 7-9, and 14-22. You agree that MyTurn, in its sole discretion, may suspend or terminate any account or your access to the Site (or any part thereof) in general, and remove and discard any content or data at any time and for any reason, with or without notice, and without MyTurn incurring any liability to you or to any third party for any claims, damages, costs or losses resulting therefrom.


Applicable Law, Binding Arbitration, and Class Action Waiver

PLEASE READ THE FOLLOWING PARAGRAPHS CAREFULLY BECAUSE THEY REQUIRE YOU TO AGREE TO RESOLVE ALL DISPUTES BETWEEN US THROUGH BINDING INDIVIDUAL ARBITRATION. These Terms will be governed by the laws in effect in the State of Virginia, without giving effect to any principles of conflicts of laws, and your acceptance of these Terms will be considered to have taken place in Virginia. As noted below, you agree to waive your right to a trial in favor of a binding arbitration process, but if for some reason a trial becomes necessary, you agree that any judicial action will be brought in the state courts of Herndon, Virginia. By accepting these Terms, you are submitting yourself to the personal jurisdiction of these courts, whichever is appropriate given the dispute at hand. Any controversy or claim arising out of or relating to this agreement, or the breach thereof, shall be settled by arbitration administered by Judicial Arbitration and Mediation Services, Inc. (“JAMS”), with one (JAMS-recommended) change: the mediator will be allowed to award attorney’s fees. The arbitrator(s) may award to the prevailing party, if any, costs, and attorneys’ fees reasonably incurred by the prevailing party in connection with the arbitration. If a party prevails on some but not all of the claims and counterclaims, the arbitrator(s) may award the prevailing party an appropriate percentage of the costs and attorneys’ fees reasonably incurred by the prevailing party in connection with the arbitration. The results of this arbitration process are binding and take the place of a trial. Any judgment made under arbitration may be submitted as a judgment in the court of law. If any damages are owed to MyTurn by the user, the user will be legally obligated to fulfill this financial obligation as if a trial had taken place. Any claim subject to arbitration must be arbitrated on an individual basis and not on a class or consolidated basis. Claims of more than one user may not be arbitrated jointly or consolidated with those of any other user. To the extent any claim is determined to not be subject to arbitration, the claim shall be tried on an individual basis and not on a class or consolidated basis. ANY RIGHT TO A JURY TRIAL IS WAIVED.


PAYMENT TERMS

Acknowledgment

Please take the time to thoroughly read these Payment Terms before making or receiving payments over the Site. By making or receiving payments using the Site, you acknowledge and agree to be bound and abide by these Payment Terms on behalf of yourself, your employer, or any other organization (as applicable). Additionally, your access to and use of the Service is contingent upon your acceptance of and compliance with MyTurns Terms and Conditions and Privacy Policy.

You acknowledge that any services that you purchase are subject to these Terms and Conditions, Privacy Policy, and any additional terms related to the provision of any product or service.

Due to the nature of the services, by accepting these terms you agree to the immediate delivery of the Services and related digital content, and you understand that you lose your right to withdraw from these Terms and Conditions.

Payments

You acknowledge that access to or ongoing use of some services offered by us or supported by our Sites may involve payment. Each product may have its own payment terms tailored to the services requirements and functionality, which will be agreed upon on the Site, in a separate agreement, insertion order, or as indicated by the Site between you and us. To minimize confusion, you acknowledge and agree that if product-specific payment terms overlap or conflict with the payment terms in this section, the product-specific terms shall dominate.

We may charge you differently for various services. Charges are calculated purely on the basis of our measurements.

If you request, we may shift your prepaid payment for the use of one product toward the use of another product (ex. service upgrades); however, we are under no obligation do so. Additionally, you understand and agree that if you have a credit card on file for our service, we will charge that same credit card for any other services until you specify otherwise.

Payment and Invoicing

You shall supply us with valid and up-to-date payment card information that we deem appropriate. If you supply us with your payment card information, you allow us to charge that card for any services purchased mentioned on the Order Form for the original subscription term and any renewal subscription term(s). These charges should be made in advance, either monthly, yearly or at the frequency specified during the purchasing process in the appropriate Order Form. If the Order Form specifies a means of payment other than a credit card, we shall charge you in advance and otherwise in line with the terms of the applicable Order Form. You are responsible for supplying us with complete and correct billing and contact information, as well as alerting us of any changes.

Subscriptions

Free Trial Period: Prior to the start of your subscription, we may provide a free trial period. You may use the services without being charged during the free trial period, subject to the terms and conditions of this agreement. If you choose not to discontinue services prior to the expiration of the free trial period, your payment card will be charged for services. After any such trial period, any request for cancellation is effective at the beginning of the next billing cycle; if you have prepaid for a subscription then cancellation is effective immediately.

Monthly Subscription: By purchasing a Monthly Subscription, you agree to pay an initial and recurring Monthly Subscription price at the then-current Monthly Subscription rate, and you accept responsibility for any subsequent charges until your subscription is cancelled. You may cancel your Monthly Subscription at any time, subject to our cancellation policys terms and conditions.

Automatic Monthly Renewal Terms: Once you have subscribed, MyTurn will process your Monthly Subscription cost automatically in the next payment cycle. Until you cancel your subscription, MyTurn will continue to automatically process your Monthly Subscription payments at the then-current Monthly Subscription cost.

Annual Subscription: By choosing an Annual Subscription, you agree to make a one-time payment in advance for a full year of service (after you are off the waitlist). After one year, you will be charged a recurring Annual Subscription renewal cost at the then-current Annual Subscription rate. We will notify you prior to billing you for the renewal charge. You may cancel your Annual Subscription at any time prior to the start of the following subscription cycle, subject to our cancellation policy.

Terms of Automatic Annual Renewal: We will charge your payment card for the Annual Subscription renewal fee in the first month of your subsequent Annual Subscription.

For instance, suppose you purchased an Annual Subscription that runs from June 1, 2022 to May 31, 2023. Unless you cancel your Annual Subscription before June 1, 2023, we will bill you for the second year (June 1, 2023 to May 31, 2024) on June 1, 2023. Prior to termination, you assume responsibility for any recurring costs. MyTurn will immediately process your Annual Subscription payment at the then-current Annual Subscription pricing after you subscribe.

Subscription Pricing Changes

Payment for your Subscription is subject to change. If your Subscription Payment is altered, we will notify you electronically and/or via your account. If you do not reject the revised modifications and terminate your subscription within thirty (30) days, your next invoice will reflect the updated rate.

Models of Billing

For subscription-based payments, you will be charged according to the terms specified in an insertion order or by the Site. If you purchase a subscription plan, you recognize and accept that your subscription will automatically renew and MyTurn will charge you on a monthly basis until you cancel your subscription plan, which may not occur until the following payment period. Pausing your profile does not result in cancellation of your subscription. We may, in our sole discretion, suspend your subscription and related expenses; if we resume the subscription, it will continue for the remainder of the period until it expires and automatically renews. The Site contains information on the resume subscription or plan. UNDER THE APPLICABLE RESUME SUBSCRIPTION PLAN, THERE ARE NO REFUNDS OR CREDITS FOR “PAUSED” OR PARTIALLY USED BILLING CYCLES. AMOUNTS PAID FOR FUTURE UNUSED BILLING CYCLES MAY RESULT IN A PRORATED REFUND OF THE UNUSED CYCLES, AS DETERMINED IN OUR SOLE DISCRETION. However, if you cancel, you will have access to the service until the end of your current paying term.

Billing Procedures

You understand and agree that we may share your credit card and related billing and payment information with organizatiorefundns that act on our behalf, such as payment processors and/or credit agencies, exclusively for the purpose of checking credit, processing payments to us, and servicing your account. Additionally, we may disclose information in response to legitimate legal process, such as subpoenas, search warrants, and court orders, or in order to establish or enforce our legal rights or defend against legal claims. You agree that we may collect updated credit and debit card payment information from payment card networks, card issuers, and other third-party sources. Additionally, you agree that we may utilize the revised card information to charge any outstanding balances. We shall not be accountable for any third parties use or disclosure of such information. Unless otherwise indicated by us, invoices may be sent to you by electronic mail. To the extent permitted by law, if you have an outstanding invoice or account balance for any of our services, we reserve the right to suspend or terminate your use of that service as well as any other service, including but not limited to those services for which you do not have an outstanding invoice or account balance.

Service Fee

In exchange for the services supplied by us, you agree to pay us service fees at such other intervals as we deem reasonable.

Payment due date

Payment of all amounts payable for purchased services is due immediately upon commencement or renewal of services.

Refused Payments

If your payment card is refused for the first time, you will be alerted through email or other electronic communication and asked to provide an updated method of payment. You may be judged unable to access our services until payment is paid.

Payment Methods

MyTurn’s currently accepted method of payment is credit card. You are advised to read through the terms and conditions and privacy policy of each payment service provider you use.

Third Party Payment Processors

Payments conducted through third-party payment processors are subject to their terms of service and privacy policies and are not accessible or controlled by us. We may obtain information about your payment card type and last four numbers, postal code, country of origin, and payment expiration date when payments are handled through third-party payment processors. For further information, we recommend that you consult the Privacy Policies of the third-party payment processor. Currently our third-party payment processor is Stripe Inc.

Credits and Credit Expiration

We may grant credit to you on occasion. Credits that are not fully utilized within 365 days will be forfeited.

Local Currencies

MyTurn may accept payment in a currency other than the United States Dollar (“USD”). Unless otherwise specified, all charges will be made in the currency listed on the payment page. MyTurns third-party payment processors handle all currency exchange services associated with payments in local currencies. However, in some circumstances, where specific currencies are not supported by specific payment methods, you will be charged in USD even though the price is indicated in another currency. In any case, the real amount charged (in the payment currency) will be indicated prior to completing the payment.

Note: Because all prices on MyTurn are always determined from their original USD pricing, non-USD currency prices may fluctuate daily due to currency exchange rate variations and may contain conversion fees. You will always have the option of paying in US Dollars simply changing the currency on their website.

If you made a payment in a currency other than USD and it was subsequently canceled for any reason, the amount restored to your MyTurn Balance will be calculated using the exchange rate in effect on the date of cancellation. As a result, the amount refunded may differ from the amount paid in local currency terms while preserving the same US Dollar value.

Promotional Codes

Occasionally, we may give you promo codes for purchasing services at a discounted rate. Promo Codes are only good for MyTurn purchases and are subject to varying time restrictions. They will expire at the end of their predetermined duration. Simply enter your coupon code on the checkout page for redemption. If you do not follow these instructions, your purchase will be ineligible for the discount. Promo coupons are valid for one time per user and cannot be used with any other offer. When placing a subscription that includes several milestones, the promo code will be applied to the first milestone only. Additional terms and limitations may apply to discount codes, which will be revealed to you upon receipt. In the event of fraud, abuse, or a violation of the Terms and Conditions, promotional coupons may be revoked. At any time, MyTurn maintains the right to change or revoke promotional codes.

Taxes

MyTurn may be required by applicable laws to charge users with indirect taxes (such as Sales Tax, VAT or GST) or to withhold taxes. Any amount MyTurn will be required to collect will be in addition to the fees payable by the user, as required by applicable laws. Indirect taxes are in addition to the price shown on the site. MyTurn will not provide users with any tax forms indicating purchased services or amounts. Users are responsible for paying any direct or indirect taxes, including any GST, VAT, or income tax, which may apply to them depending on residency, location or otherwise, under provisions of their jurisdiction.


CANCELLATIONS & REFUND POLICY

We do our best to describe every product or service offered on the Service as accurately as possible. However, we are human, and therefore we do not warrant that product specifications, pricing, or other content on the online services are complete, accurate, reliable, current, or error-free. In the event of any errors relating to the pricing or specifications, MyTurn shall have the right to refuse or cancel any payments or orders in its sole discretion. Additional terms may apply.

Disputes and Cancellations

You may cancel your subscription anytime by clicking “Cancel Subscription” within your Account. Any such cancellation shall be reflected in the next billing cycle. Once the billing cycle has begun, no refunds are permitted.

Users experiencing issues regarding the subscription service, are first advised to use the Sites dispute resolution mechanisms to address payment related issues regarding disputes and cancellations. When permitted, Customer Support can conduct refunds or cancellations on behalf of MyTurn.

Filing a transaction dispute with your payment provider or bank or reversing a payment is a violation of these Payment Terms. By doing so, you risk having your account terminated temporarily or permanently. If you submit a dispute with your payment provider, the funds will be ineligible for reimbursement owing to our contractual obligations to the payment provider.

MyTurn, in conjunction with its third-party payment processor, retains the right to cancel orders or place payments on hold in the event of suspected fraudulent transactions on the Site.

MyTurns Customer Support staff will determine eligibility for subscription requests based on a variety of factors, including breaches of our Terms and Conditions and Privacy Policy.

Involuntary Cancellation

In the event of the user’s breach of our Terms and Conditions or Privacy Policy, we reserve the right to terminate our services to you without cause immediately and without prior notice. In such an event, no refund of payments shall be permitted. You are instructed to contact MyTurn, see below for contact information.

Chargebacks

MyTurn investigates chargebacks and disputes with payment providers. Although results vary per chargeback cause, we make every effort to resolve disputes in the user’s favor. If the chargeback case permits, MyTurn (or one of Myturn’s third-party payment processors) will refund some or all payment to users; otherwise, the user will bear the chargeback amount.

Refunds MyTurn does not refund payment immediately or automatically.

Modifications to Payment Terms

MyTurn has the right to modify these Payment Terms at any moment. When these modifications are made, MyTurn will update this page with an updated copy of the Terms and Conditions.

You acknowledge and agree that if you use MyTurn following the effective date of the amended Terms and Conditions, MyTurn will regard your use as acceptance of the updated Payment Terms.
